INTERNAL RULES – Training organization
TOTEM CPL ESTABLISHED IN ACCORDANCE WITH ARTICLES L6352-3 AND L6352-4 AND R6352-1 TO R6352-15 DU CODE DUTRAVAIL
ARTICLE 1 – PURPOSE AND SCOPE: These rules apply to all participants in training courses organized by TOTEM CPL. They are displayed at all training locations and are presented at the start of training sessions. All participants must abide by the terms of these rules throughout the training program.
ARTICLE 2 – GENERAL PRINCIPLES: Preventing the risk of accidents and illness is imperative, and requires full compliance with all applicable health and safety regulations. To this end, the general and specific safety instructions in force in the establishment hosting the training sessions, where they exist, must be strictly complied with, on pain of sanctions.
Section 1: HYGIENE AND SAFETY RULES
Each trainee is responsible for his or her own personal safety and that of others, and for complying with general and specific health and safety instructions, depending on the course.
ARTICLE 3 – FIRE INSTRUCTIONS: Fire instructions, and in particular the emergency evacuation plan, are posted on the training organization’s premises (on the ground floor: in the hall next to the entrance door), and trainees must familiarize themselves with them.
In the event of an alarm, trainees must cease all training activities and calmly follow the instructions of the authorized representative of the training organization or the emergency services.
Any trainee witnessing a fire must immediately call for help by dialing 18 from a landline or 112 from a cell phone, and alert a representative of the training organization.
ARTICLE 4 – DRINKS AND DRUGS: The introduction or consumption of drugs or alcoholic beverages on the premises is strictly forbidden. It is forbidden for trainees to enter or remain within the training organization in a state of intoxication or under the influence of drugs.
ARTICLE 5 – NO SMOKING: Smoking is strictly forbidden in training rooms and, more generally, on the premises of the training organization.
ARTICLE 6 – ACCIDENT: Any trainee who is the victim of an accident (occurring during training or during the journey between the training site and his/her home or workplace), or who witnesses such an accident, must immediately inform the management of the training organization. The training organization’s manager takes the appropriate steps to seek medical attention, informs the trainee’s employer and takes part in the declaration to the relevant social security fund.
ARTICLE 7 – WORKING HOURS, ABSENCES, LATE ARRIVALS OR EARLY DEPARTURES : trainees must comply with the timetable set and communicated in advance by the training organization. In the event of absence, lateness or departure before the scheduled time, trainees must inform the training organization and justify themselves.
The training organization immediately informs the financer (employer, administration, Fongécif, Region, Pôle emploi…) of this event.
In addition, in accordance with article R6341_45 of the French Labor Code, the trainee – whose remuneration is paid by the public authorities – is liable to a deduction from his or her remuneration proportional to the duration of the absence.
ARTICLE 8 – FORMALITY: The trainee is required to fill in the attendance sheet as the course progresses, and to complete the satisfaction questionnaire at the end of the course. Trainees may be asked to complete a training assessment.
ARTICLE 9 – BEHAVIOR: All trainees are expected to behave in a way that ensures respect for the basic rules of good manners and community life, and the smooth running of training courses.
ARTICLE 10 – PERSONAL PROPERTY: The organization declines all responsibility in the event of loss, theft or damage to personal items of any kind belonging to trainees.
ARTICLE 11 – PENALTIES: Any failure by a trainee to comply with any of the provisions of these internal regulations may result in temporary or permanent exclusion from the course. This sanction will be accompanied by notification of the trainee’s employer. A disciplinary sanction may then be imposed by the trainee’s employer, depending on its nature and severity: call to order, written warning, reprimand, layoff, dismissal. Fines or other financial penalties are prohibited.
ARTICLE 12 – ACCESS TO TRAINING PREMISES :
Unless expressly authorized by the management of the training organization, the trainee may not :
- Entering or remaining on training premises for purposes other than training;
- Introduce, arrange for the introduction of or facilitate the introduction of persons not belonging to the organization;
- Sell goods or services in the latter.
ARTICLE 13 – USE OF EQUIPMENT :
Unless specifically authorized by the training organization’s management, training equipment may only be used on the training premises and exclusively for training purposes. The use of equipment for personal purposes is prohibited.
Trainees are required to keep the equipment entrusted to them for training in good condition. They must use it in accordance with its purpose and the rules issued by the trainer.
The trainee must immediately report any equipment malfunction to the trainer.
